Under Order XVII Rule 3 CPC the court may proceed to decide the suit forthwith where a party fails, without sufficient cause, to produce evidence or perform an act necessary to progress. Dismissal for default of appearance, by contrast, falls under Order IX. Restoration of a suit dismissed for non-prosecution is sought by application showing sufficient cause; the limitation is governed by Article 168 of the Limitation Act 1908 (thirty days from dismissal). Courts lean towards adjudication on merits where the default is not contumacious.
In practice, attach an affidavit explaining each adjournment and demonstrate that the default was neither wilful nor negligent. The superior courts have repeatedly restored suits where counsel's absence was bona fide and the other side suffers no irreparable prejudice.
